Effective Date: May 24, 2026

DonateElectronics.com is owned and operated by Event Media 770 Corp.

Welcome to DonateElectronics.com. These Terms of Use govern your access to and use of the DonateElectronics.com website, forms, content, communications, donation intake pages, device submission pages, and related services. In these Terms of Use, "Company," "DonateElectronics.com," "we," "us," and "our" refer to Event Media 770 Corp.

By accessing this website, submitting information through our forms, communicating with us, requesting device donation or recycling services, or using any part of our website or related services, you agree to these Terms of Use. If you do not agree, you should not use this website or submit information through it.

Your use of the website and submission of information are also subject to our Privacy Policy, which explains how we collect, use, disclose, share, store, and protect information.

1. About DonateElectronics.com

DonateElectronics.com operates as an online intake, referral, and information platform for individuals, businesses, organizations, and other users interested in donating, recycling, or submitting electronic devices for processing through third-party processing partners.

DonateElectronics.com may collect information from users and share that information with selected third-party processing partners, including The Wireless Alliance, who may assist with device processing, shipping instructions, recycling, refurbishment, resale, data-sanitization, data-erasure, destruction, reporting, or related services.

Unless expressly stated in a separate written agreement signed by DonateElectronics.com, DonateElectronics.com does not physically receive, inspect, wipe, erase, refurbish, recycle, resell, destroy, or process electronic devices itself.

2. Third-Party Device Processing Partners

DonateElectronics.com works with third-party processing partners, including The Wireless Alliance, to help process donated and recycled electronic devices. DonateElectronics.com operates as an online intake, referral, and information platform. We do not physically receive, inspect, wipe, erase, refurbish, recycle, resell, or destroy devices ourselves.

Devices submitted through DonateElectronics.com may be processed by The Wireless Alliance or another designated third-party processing partner. Device processing, recycling, refurbishment, resale, data-sanitization, data-erasure, destruction, reporting, and related services are handled by the applicable third-party processing partner according to its own policies, procedures, certifications, operating practices, terms, privacy practices, and available customer resources.

The Wireless Alliance states on its website that it takes data seriously, uses data-sanitization procedures, follows certain NIST media-sanitization practices, and may provide Certificates of Recycling and Data Destruction upon request. Because third-party policies, procedures, certifications, links, downloads, and services may change from time to time, users should review The Wireless Alliance's current website, customer resources, data-security information, device-preparation instructions, downloadable materials, certificates, and any other applicable policies or materials before submitting any device.

DonateElectronics.com is not responsible for the availability, accuracy, completeness, content, updates, or functionality of any third-party website, download, certificate, resource, policy, or material.

3. No Guarantee of Device Acceptance, Value, Processing, or Results

Submitting information through DonateElectronics.com does not guarantee that:

  • Any device will be accepted;
  • Any device will have resale, recycling, trade-in, or donation value;
  • Any partner will contact you;
  • Any shipping label, pickup, box, or processing arrangement will be provided;
  • Any device will be recycled, refurbished, resold, donated, destroyed, or processed in a particular way;
  • Any specific certificate, report, confirmation, or documentation will be issued;
  • Any data-sanitization, data-erasure, or destruction result will be achieved by DonateElectronics.com;
  • Any third-party processing partner will be suitable for your needs.

Any services provided by a third-party processing partner are subject to that partner's own policies, procedures, certifications, scope of services, warranties, limitations, data practices, recycling practices, shipping practices, and business practices.

4. User Responsibility for Device Data

Before submitting, shipping, donating, recycling, or otherwise transferring any electronic device through DonateElectronics.com, you are responsible for backing up, deleting, wiping, factory-resetting, unlocking, and removing all personal, confidential, sensitive, financial, medical, business, proprietary, or other data from the device.

This includes, without limitation, removing or deleting contacts, photos, videos, messages, emails, documents, passwords, payment information, browser history, account credentials, applications, cloud accounts, device locks, activation locks, SIM cards, SD cards, memory cards, and any other stored information or removable storage media.

DonateElectronics.com does not inspect, access, erase, wipe, destroy, recover, secure, or verify the removal of data from any device. You acknowledge and agree that any device you submit may contain personal or sensitive information unless you remove it before submission, and you assume responsibility for removing that information before sending the device.

5. Device Preparation Before Submission

Before sending any device, you should back up any information you wish to keep, remove personal information, sign out of accounts, remove SIM cards and memory cards, and disable any device-tracking, device-locking, or activation-lock features.

For Apple devices, this may include turning off "Find My iPhone" / Activation Lock and erasing all content and settings before sending the device. For Android and other devices, you should follow the manufacturer's current instructions for removing accounts, locks, tracking features, activation-lock features, and personal data.

The Wireless Alliance provides device-preparation information on its website, including guidance regarding Find My iPhone / Activation Lock. Because device settings, manufacturer instructions, third-party instructions, and processing requirements may change, you should review the current instructions from The Wireless Alliance and the device manufacturer before sending your device.

6. No Data-Erasure Services by DonateElectronics.com

DonateElectronics.com does not provide data-erasure, data-wiping, data-destruction, cybersecurity, identity theft protection, or information security services.

Although our processing partners may provide data-sanitization, data-erasure, recycling, or destruction procedures as part of their processing services, DonateElectronics.com does not itself wipe, erase, inspect, destroy, verify, or guarantee the removal of data from any device.

Any data handling, device processing, recycling, refurbishment, resale, or destruction services are performed by third-party processing partners and are subject to their own policies, procedures, standards, certifications, and operating practices.

7. Referral, Partner, and Compensation Disclosure

By submitting a form, requesting information, submitting a device, requesting donation or recycling services, or otherwise providing your information to DonateElectronics.com, you authorize DonateElectronics.com to review your information and, where appropriate, share it with one or more selected third-party processing partners who may process or support your request.

DonateElectronics.com may receive referral fees, marketing fees, lead generation fees, processing fees, commissions, revenue share, consulting fees, or other compensation from partners in connection with device submissions, donations, recycling requests, referrals, introductions, or resulting business activity.

You understand and agree that DonateElectronics.com may have a financial or business relationship with the partners to whom your information is referred.

8. No Professional Advice

The content on this website is provided for general informational and business purposes only. It should not be considered legal, financial, accounting, tax, technical, cybersecurity, privacy, environmental, recycling, regulatory, compliance, data-security, identity-theft, or professional advice.

You should consult qualified advisors before making important legal, financial, technical, security, privacy, compliance, environmental, or operational decisions.

9. User Responsibilities

You agree that all information you submit through the website will be accurate, current, and complete to the best of your knowledge.

You are responsible for evaluating any third-party processing partner, recycler, refurbisher, logistics provider, shipping provider, or service provider before proceeding. You should review the partner's current policies, procedures, certifications, data-security information, shipping instructions, device-preparation instructions, privacy practices, and available customer resources before submitting any device.

You are solely responsible for determining whether submitting a device through DonateElectronics.com or a third-party processing partner is appropriate for your needs.

10. Third-Party Partners and Services

DonateElectronics.com is not responsible for the acts, omissions, representations, warranties, services, pricing, processing decisions, shipping procedures, recycling procedures, data-security practices, privacy practices, device-handling practices, reporting practices, delays, errors, failures, or performance of any third-party processing partner or service provider.

Any dispute between you and a third-party processing partner is solely between you and that partner. DonateElectronics.com is not liable for any damages, losses, claims, costs, delays, data loss, privacy incident, security incident, device loss, device damage, failed processing, failed recycling, failed resale, failed refurbishment, data-erasure issue, or other harm arising from your relationship with a third-party processing partner.

11. No Employment, Agency, Joint Venture, or Partnership Relationship

Nothing on this website or in these Terms creates an employment, agency, joint venture, fiduciary, partnership, franchise, representative, or other special relationship between you and DonateElectronics.com or between DonateElectronics.com and any third-party processing partner, unless expressly agreed in a separate written contract signed by the applicable parties.

The website and related services are provided on an "as is" and "as available" basis. DonateElectronics.com makes no warranties or representations of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, uptime, security, reliability, suitability, or error-free operation.

16. Limitation of Liability

To the fullest extent permitted by law, DonateElectronics.com, Event Media 770 Corp., and their respective owners, officers, directors, employees, contractors, affiliates, representatives, agents, licensors, service providers, and business partners shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, enhanced, or lost-profit damages arising out of or related to your use of the website, submission of information, device submission, donation request, recycling request, shipment, referral to a partner, communication with a partner, engagement with any third-party provider, or reliance on any website content.

This release applies whether the claim arises from unauthorized access, identity theft, data breach, disclosure, loss of privacy, financial loss, account access, business loss, device misuse, third-party conduct, or any other alleged harm relating to data left on a submitted device.

18. Indemnification

Accessing third-party links is at your own risk.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms.

21. Governing Law

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the website, any submitted inquiry, any device submission, any donation request, any recycling request, any shipment, any referral, any communication with DonateElectronics.com, or any relationship with DonateElectronics.com shall be governed by the laws of the State of New York, without regard to conflict-of-law principles.

22. Binding Arbitration; American Arbitration Association; New York Venue

Please read this section carefully. It requires certain disputes to be resolved through binding arbitration rather than in court, except where prohibited by law or expressly stated below.

22.1 Agreement to Arbitrate

To the fullest extent permitted by law, any dispute, claim, demand, cause of action, or controversy arising out of or relating to these Terms, the website, your use of the website, any form submission, any device submission, any donation request, any recycling request, any shipment, any communication with DonateElectronics.com, any referral to or interaction with a third-party processing partner, any alleged privacy or data-related issue, any information left on or associated with a submitted device, any data-sanitization, data-erasure, recycling, refurbishment, resale, destruction, reporting, or processing issue, any compensation or referral arrangement, or any relationship or interaction with DonateElectronics.com shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA).

22.2 AAA Rules

The arbitration shall be administered by the American Arbitration Association under its applicable rules, including, where applicable, the AAA Commercial Arbitration Rules or other AAA rules determined by the AAA to apply to the dispute.

If there is any conflict between these Terms and the applicable AAA rules, these Terms shall control to the fullest extent permitted by law, unless the AAA rules or applicable law require otherwise.

22.3 Location and Venue of Arbitration

The arbitration shall take place in New York, New York, unless the parties mutually agree in writing to conduct the arbitration remotely, by video conference, by telephone, or based on written submissions.

The parties agree that New York, New York is a convenient and appropriate venue for arbitration. The arbitrator shall have authority to permit remote appearances, virtual hearings, or other procedures designed to reduce cost and improve efficiency.

22.4 Authority of the Arbitrator

The arbitrator shall have authority to resolve all issues submitted to arbitration, including issues relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, except where applicable law requires a court to decide a particular issue.

The arbitrator may award any individual relief that would be available in a court of competent jurisdiction, subject to the limitations of liability, disclaimers, and other terms set forth in these Terms.

22.5 Individual Claims Only; No Class Actions

To the fullest extent permitted by law, all disputes shall be brought and resolved only on an individual basis. You and DonateElectronics.com agree that neither party may bring or participate in any class action, collective action, consolidated action, representative action, private attorney general action, or similar proceeding in arbitration or in court.

The arbitrator may not consolidate the claims of multiple persons or entities and may not preside over any class, collective, consolidated, or representative proceeding, unless both parties expressly agree in writing.

22.6 Jury Trial Waiver

To the fullest extent permitted by law, you and DonateElectronics.com knowingly and voluntarily waive any right to a trial by jury for any dispute, claim, or controversy arising out of or relating to these Terms, the website, any submitted inquiry, any device submission, any donation request, any recycling request, any shipment, any referral, or any relationship with DonateElectronics.com.

22.7 Court Proceedings for Limited Purposes

Notwithstanding the agreement to arbitrate, either party may seek temporary, preliminary, or emergency injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, data, systems, business relationships, or other rights pending the appointment of an arbitrator or final resolution of the dispute.

Either party may also bring an action in court to compel arbitration, stay court proceedings, confirm an arbitration award, modify an arbitration award, or enforce an arbitration award.

22.8 Fees and Costs

Arbitration fees and costs shall be allocated in accordance with the applicable AAA rules, unless otherwise required by law or ordered by the arbitrator. Each party shall be responsible for its own attorneys' fees and costs unless a statute, contract, or arbitrator's award provides otherwise.

22.9 Confidentiality of Arbitration

To the fullest extent permitted by law, the arbitration proceeding, submissions, evidence, testimony, documents, settlement discussions, and award shall be kept confidential, except as necessary to conduct the arbitration, comply with law, enforce or challenge an award, seek judicial relief, or disclose information to legal, accounting, tax, insurance, or other professional advisors.

22.10 Time Limit to Bring Claims

To the fullest extent permitted by law, any claim or dispute arising out of or relating to these Terms, the website, any form submission, any device submission, any donation request, any recycling request, any shipment, any referral, any third-party processing partner, any alleged privacy or data-related issue, or any relationship with DonateElectronics.com must be brought within one (1) year after the claim accrues. Any claim not brought within that period is permanently barred, unless applicable law requires a longer period.

22.11 Severability of Arbitration Terms

If any part of this arbitration section is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect to the fullest extent permitted by law. If the class action waiver is found to be invalid or unenforceable as to a particular claim or request for relief, then that claim or request for relief shall proceed in court and not in arbitration, unless otherwise permitted by law.
